This is a convenience translation. The German version is the legally binding one.
In one sentence: playing is free and funded by advertising. If you would rather play without ads, that costs 1.69 € a month. Nothing else is for sale.
§ 1 Scope and subject matter
These terms govern the use of the game Fleet Chess (German: Flottenschach) as an Android app and as a web application, and the use of this website. The provider is Mike Fröse, Berliner Str. 12, 58566 Kierspe, Germany (the "provider"; full details in the imprint).
Installing or opening the game forms a free-of-charge usage agreement for the version provided. Any diverging terms of the user do not apply.
§ 2 The service
The provider makes available:
- the game for play against a computer opponent and two players on one device, both without a network connection;
- an online function allowing two devices to play a match against each other;
- a feedback inbox reachable from within the app.
Use of the game is free of charge. It is funded by advertising shown between matches. In addition, a paid subscription is offered that switches the advertising off (§ 5a).
Progress (ranks, shipyard points) is earned solely by playing. It cannot be bought, and the subscription grants no advantage inside the game.
§ 2a Advertising
The free version displays advertising. It appears between matches and not during a running battle. The ads are served by Google.
Before the first ad is shown, the consent required under data protection law is obtained; it can be withdrawn at any time. Details are in the privacy policy. The respective advertiser, not the provider, is responsible for the content of the ads.
§ 3 No account, no registration
No registration is required. For online matches the device signs in anonymously. There is therefore no entitlement to recovery of progress, ranks or friends lists after changing device, reinstalling or clearing application data. The game provides a backup file for moving to another device; keeping it is the user's responsibility.
§ 4 User obligations
The following are prohibited:
- using call signs or submitting feedback that is unlawful, insulting, discriminatory, harmful to minors or evidently liable to infringe third-party rights, including the use of other people's names, trade marks or personal data;
- circumventing, manipulating or automatically addressing the server interfaces, in particular mass-creating matches or systematically guessing other players' join codes;
- anything that impairs availability for others (overloading, disruption, reverse engineering for the purpose of manipulation);
- using the service for any purpose other than playing.
The provider may change or mask call signs that breach these obligations, end individual matches, and suspend access to the online function temporarily or permanently. There is no prior moderation of content; call signs are checked automatically against a block list.
Notices of unlawful content are accepted at the address given in the imprint and will be acted upon.
§ 5 Availability
The offline modes work independently of the provider. No particular availability is promised for the online function. It may be temporarily unreachable for maintenance, updates or technical reasons. The provider may discontinue the online function on reasonable notice; the game remains usable in its offline modes.
So that app and server match, the app checks the server's version when the online area is opened. If they do not match, the online function is locked until the app is updated. This is a safeguard against broken matches, not a defect.
§ 5a Ad-free subscription
What it does. For a fee the advertising is switched off. Nothing about the scope of the game changes.
Price. 1.69 € per month. That is the final price; no further costs arise. The provider is a small business under § 19 of the German VAT Act and shows no VAT.
Conclusion and handling. The subscription is concluded and billed through the store the game was obtained from (Google Play or the App Store). It renews automatically by one month at a time unless cancelled.
Cancellation. At any time, effective at the end of the current billing period, through the subscription management of the respective store. Cancelling with the provider is neither required nor possible, because the provider has no access to your store account.
Right of withdrawal. Consumers have a 14 day right of withdrawal for contracts covering digital services. It expires early where performance begins before the period ends at the consumer's express request, the consumer has agreed to this and has confirmed awareness that the right expires (§ 356 (5) of the German Civil Code). The respective store collects that confirmation during checkout.
Refunds follow the terms of the store the purchase was made through.
§ 6 Rights in the game
All rights in the game, its graphics, texts, sounds and source code remain with the provider or the respective rights holders. The user receives a simple, non-transferable, revocable right to use the game on their devices for private purposes.
Not permitted are, in particular, modifying, decompiling (except where mandatorily allowed by law), reproducing for redistribution, and offering the game or its components for a fee.
§ 7 User content
For call signs and feedback the user grants the provider the right to store them to the technically necessary extent and, in the case of the call sign, to display them to the respective opponent. No further use, in particular no publication, takes place.
§ 8 Warranty and liability
The game is provided free of charge. The statutory provisions for supplying digital products without consideration therefore apply, and the provider's liability is limited accordingly.
The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealed defects and under the German Product Liability Act.
For ordinary negligence the provider is liable only for breach of material contractual obligations (obligations whose fulfilment makes proper performance possible in the first place and on whose observance the user may regularly rely), limited in amount to the foreseeable damage typical of this type of contract. Liability is otherwise excluded.
In particular there is no liability for the loss of progress, ranks, shipyard points or friends lists, for the interruption of running online matches, or for data loss caused by the absence of the user's own backup. The game's export function is available for backing up the profile.
§ 9 Termination
The user may stop using the service at any time by uninstalling the app or no longer opening the application. The provider may suspend access to the online function in the event of serious or repeated breaches of § 4.
§ 10 Changes to these terms
The provider may amend these terms with effect for the future where necessary to reflect changes in law, case law or functionality, and where this does not unreasonably disadvantage the user. The version published here, bearing the date above, is the applicable one.
§ 11 Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.
§ 12 Severability
Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
§ 13 Relationship to app store terms
If the app is obtained from an app store, that store's terms additionally apply between the user and the store operator. The store operator is not a party to this usage agreement and owes no performance under it.
